Customer Terms of Service
IMPORTANT: PitPilot is a referral and technology platform. PitPilot does not diagnose vehicles, set a Service Provider’s final price, perform repairs, or employ or control the independent businesses that perform automotive services. Any agreement for diagnostic, maintenance, or repair services is made directly between you and the Service Provider you select or accept.
These Customer Terms of Service (the “Terms”) are a binding agreement between you and CHC Technology Group LLC, d/b/a PitPilot (“PitPilot,” “we,” “us,” or “our”). They govern your use of gopitpilot.com, related websites, forms, telephone numbers, text messaging, and referral or scheduling services (collectively, the “Platform”).
By submitting a request, communicating through the Platform, scheduling with a Service Provider introduced through PitPilot, or otherwise using the Platform, you agree to these Terms and acknowledge our Privacy Policy at https://gopitpilot.com/privacy-policy/. If you do not agree, do not use the Platform.
1. Eligibility and authority
You must be at least 18 years old and legally able to enter a contract. You represent that you own the vehicle or have the owner’s authority to request and authorize services. You are responsible for providing accurate vehicle, location, contact, and problem information.
2. PitPilot’s limited role
PitPilot helps customers locate and connect with independent mobile mechanics, technicians, repair businesses, and other automotive service providers (each, a “Service Provider”). PitPilot may transmit requests, facilitate communications, and provide scheduling or related administrative support.
PitPilot is not a motor vehicle repair shop and does not itself inspect, diagnose, maintain, repair, tow, possess, or control your vehicle. Unless PitPilot expressly states otherwise in a separate written agreement, PitPilot is not a party to the agreement between you and a Service Provider for diagnosis, labor, parts, warranties, or other vehicle services (the “Service Agreement”).
A referral, listing, badge, availability statement, or transmission of a request is not an endorsement, certification, guarantee, or warranty of any Service Provider or result.
3. Independent Service Providers
Service Providers are independent businesses and are not PitPilot’s employees, agents, joint venturers, partners, franchisees, or representatives. They control the method and manner of their work, service recommendations, availability, personnel, tools, parts, safety procedures, estimates, prices, collections, refunds, and warranties.
PitPilot does not direct or supervise automotive work and does not guarantee that a Service Provider is licensed, registered, insured, bonded, qualified, available, or suitable for your particular request. PitPilot may collect information from Service Providers, but you remain responsible for evaluating the Service Provider and confirming any credentials, registrations, insurance, and warranty terms important to you.
4. Estimates, authorization, pricing, and payment
Any price, range, or description shown or communicated by PitPilot before a Service Provider evaluates the vehicle is informational only unless expressly identified as a binding PitPilot charge. The Service Provider is solely responsible for providing any estimate, disclosure, work authorization, invoice, and notice of additional charges required by law.
Before work begins, review the Service Provider’s identity, scope, estimate, parts terms, labor rate, cancellation or diagnostic fee, taxes, payment terms, and warranty. Do not authorize work you do not understand.
Unless the checkout page expressly identifies PitPilot as the merchant for a specific Platform fee, all repair-related amounts are owed directly to the Service Provider. PitPilot is not responsible for billing disputes, chargebacks, refunds, liens, financing, or collections arising from the Service Agreement.
5. Customer responsibilities and safe service location
You must provide a lawful, reasonably safe, accessible, and sufficiently level location for service; disclose known hazards and relevant vehicle conditions; keep children, pets, and bystanders away from the work area; and comply with the Service Provider’s reasonable safety instructions.
Do not request work in an active traffic lane or other unsafe location. The Platform is not an emergency, towing, roadside-rescue, or 911 service. If you or others face immediate danger, call 911 or the appropriate emergency or roadside-assistance provider.
6. Cancellations, rescheduling, and no-shows
Cancellation, rescheduling, trip, diagnostic, inspection, or no-show fees are determined by the Service Provider or disclosed during booking. PitPilot may communicate those policies but is not responsible for enforcing or refunding a Service Provider’s charge. No arrival or completion time is guaranteed; traffic, weather, parts, prior jobs, safety issues, and diagnostic findings may cause delay or cancellation.
7. Parts, workmanship, and warranties
All parts, labor, diagnoses, recommendations, representations, and warranties are provided solely by the Service Provider or applicable manufacturer. Obtain warranty terms in writing from the Service Provider. PitPilot does not provide or administer any repair, parts, workmanship, merchantability, fitness, roadside, or vehicle-operability warranty.
8. Complaints and claims involving service work
Promptly notify the Service Provider of any concern involving diagnosis, workmanship, parts, charges, delay, personal injury, property damage, loss, or warranty service, and preserve photographs, invoices, communications, replaced parts, and other evidence. You may also notify PitPilot at admin@gopitpilot.com so we can document the issue or facilitate communication, but PitPilot is not required to investigate, mediate, pay, repair, refund, or resolve a dispute between you and a Service Provider.
Nothing in these Terms limits any non-waivable right or remedy you may have against the Service Provider under applicable law.
9. Platform communications
You consent to receive service-related calls, emails, and text messages from PitPilot and Service Providers at the contact information you provide, including messages sent using automated technology where permitted by law. Consent to marketing is not a condition of purchase. Message and data rates may apply. You may opt out of marketing texts by replying STOP, but you may still receive non-marketing messages necessary to address an active request.
10. Acceptable use
You may not misuse the Platform; submit false, fraudulent, abusive, unlawful, or hazardous requests; impersonate another person; interfere with Platform operation; scrape or copy Platform content; introduce malicious code; or use the Platform to threaten, harass, discriminate against, or harm another person. PitPilot may refuse, suspend, or terminate access when reasonably necessary to protect users, Service Providers, PitPilot, or the public.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM AND ALL REFERRAL, MATCHING, COMMUNICATION, AND SCHEDULING FUNCTIONS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” PITPILOT DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES CONCERNING THE PLATFORM, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
PITPILOT DOES NOT WARRANT OR GUARANTEE ANY SERVICE PROVIDER; DIAGNOSIS; ESTIMATE; PRICE; ARRIVAL OR COMPLETION TIME; PART; REPAIR; WORKMANSHIP; SAFETY; LEGAL COMPLIANCE; INSURANCE; VEHICLE CONDITION; OR OUTCOME. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO THESE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.
12. Limitation of PitPilot’s liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PITPILOT AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, AND PLATFORM VENDORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF USE, PROFITS, DATA, BUSINESS, OR VALUE; TOWING, RENTAL, LODGING, TRAVEL, OR SUBSTITUTE-TRANSPORTATION COSTS; OR ANY PERSONAL INJURY, DEATH, VEHICLE DAMAGE, THEFT, PROPERTY DAMAGE, MISDIAGNOSIS, DEFECTIVE PART, FAULTY WORKMANSHIP, DELAY, FAILURE TO APPEAR, OR OTHER ACT OR OMISSION OF A SERVICE PROVIDER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PITPILOT’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE PLATFORM FEES YOU PAID DIRECTLY TO PITPILOT DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
These limits do not exclude liability that cannot lawfully be excluded or limited, and they apply regardless of the legal theory and even if a remedy fails of its essential purpose.
13. Your responsibility for third-party claims
To the extent permitted by law, you will defend, indemnify, and hold harmless PitPilot and its owners, officers, employees, and affiliates from third-party claims, losses, liabilities, damages, judgments, and reasonable legal fees arising from your unlawful or intentional misuse of the Platform; your material breach of these Terms; inaccurate information you knowingly provide; or an unsafe condition you knowingly create or fail to disclose at the service location. This section does not require you to indemnify PitPilot for PitPilot’s own negligence, willful misconduct, or violation of law.
14. Dispute resolution; individual arbitration; class-action waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO GO TO COURT.
Before filing a claim against PitPilot, you and PitPilot will each give the other a written notice describing the claim and requested relief and will attempt in good faith for 30 days to resolve it informally. Send notices to admin@gopitpilot.com. This requirement does not prevent either party from seeking emergency injunctive relief.
Except for an individual claim eligible for small-claims court and claims that applicable law does not permit to be arbitrated, any dispute between you and PitPilot arising out of or relating to these Terms or the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association under its then-current Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitration may occur by video, telephone, documents, or in Lake County, Florida, as the applicable rules permit. PitPilot will pay arbitration fees to the extent required by those rules or applicable law.
YOU AND PITPILOT WAIVE THE RIGHT TO A JURY TRIAL AND AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION. The arbitrator may award relief only to the individual claimant and only as necessary to resolve that claimant’s claim.
You may opt out of arbitration by sending a signed written notice to admin@gopitpilot.com within 30 days after you first accept these Terms. The notice must include your name, contact information, and a clear statement that you opt out of arbitration. Opting out will not affect your use of the Platform. If you timely opt out, or if arbitration is unavailable, exclusive venue for claims against PitPilot will be the state or federal courts located in Lake County, Florida, except where applicable law requires otherwise.
15. Governing law
These Terms are governed by Florida law, without regard to conflict-of-laws rules, except that the Federal Arbitration Act governs Section 14. Mandatory consumer protections of your state of residence continue to apply when they cannot lawfully be waived.
16. Changes to the Platform or Terms
PitPilot may modify or discontinue Platform features and may update these Terms prospectively. The updated version will state a new “Last updated” date. When required by law, we will provide additional notice or obtain consent. Changes do not retroactively alter a dispute that arose before the updated Terms became effective.
17. Intellectual property
The Platform, PitPilot name and branding, site content, software, and related materials are owned by PitPilot or its licensors and protected by law. Subject to these Terms, PitPilot grants you a limited, revocable, nonexclusive, nontransferable right to use the Platform for your personal, noncommercial purpose of requesting automotive services.
18. General terms
These Terms and any policies expressly incorporated by reference are the entire agreement between you and PitPilot concerning the Platform. They do not replace your separate Service Agreement with a Service Provider. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue in effect. PitPilot’s failure to enforce a provision is not a waiver. You may not assign these Terms without PitPilot’s written consent; PitPilot may assign them in connection with a merger, reorganization, sale of assets, or similar transaction. Headings are for convenience only.
